What kind of companies can apply for payroll refund protection?
We are able to provide protection to US based small businesses with employees that:
- claimed (or expect to claim) a payroll refund under the Employee Retention Credit (ERC) Program.
- had at least five (non-owner related) employees who were on payroll in either Q2-Q4 2020 or Q1-Q3 2021.
- had no more than five hundred (500) full-time employees on payroll in 2019.
- are deemed a small employer by the IRS. For clarity, this means that some companies will qualify for ERC Audit Defense protection for ERC payroll refund claims made in 2021 but not in 2020 (this happens when the company employed more than 100 full-time employees on average in 2019 but less than 500).
What kind of documentation will I need when applying for payroll refund protection?

- The application questions are straightforward (e.g. company and contact information, approximate size, whether you have – or can provide documentation in the future – after the application process)
How soon after I apply do I receive ERC Audit Defense protection?
Immediately.
Once a successful application has been submitted, our system auto-generates your protection agreement.
- This means you have ERC payroll refund protection and that we will represent you through the completion of any ERC payroll refund audit for the payroll tax return identified on your membership certificate while there is an active agreement in place.
