- Court System. Once all administrative remedies have been exhausted and if your ERC claim remains unpaid, you can then file a lawsuit against the IRS in either a U.S. District Court or U.S Tax Court depending on your specific situation.

How to claim ERC
Here’s how the process to claim your payroll refund works:
Interview
Your tax professional will guide you through a thirty minute working session and then request certain documents be provided through a secure portal. We then identify, analyze, calculate, and document the ERC payroll refund amount you are eligible to receive from the IRS.
Amend Returns
To receive your payroll refund you must first file amended payroll tax returns. Your tax professional will help prepare the documentation required for you to file your Adjusted Employer’s Quarterly Federal Tax Returns (Forms 941-X) for those quarters where you qualify to claim ERC.
IRS Refund Check
You will receive payment directly from the IRS. The IRS will mail paper checks for each of your ERC claims to the address they have for you on file. We get paid after you receive your ERC payroll refund.
